Illinois: you must be told when AI is used on your application

Since January 2026 an Illinois employer has to notify you when artificial intelligence is used in a hiring, promotion or other employment decision, and may not use your zip code as a stand-in for a protected characteristic.

What the law covers

HB 3773 amends the Illinois Human Rights Act and took effect on 1 January 2026. It reaches recruitment, hiring, promotion, discipline and discharge, so it is broader than a hiring rule.

To be told when AI is used in a decision about you. The Act also prohibits an employer from using a zip code as a proxy for a protected class, which addresses a specific and well documented route by which a model reproduces discrimination it was never explicitly taught.

The gap worth knowing about

The Illinois Department of Human Rights proposed rules setting out when notice must be given, in what wording and by what means, and then withdrew them.

The statutory duty is unaffected and still applies. What is unsettled is the detail, so the notice you receive may vary between employers, and there is no standard form to compare it against yet.

If you applied to an Illinois employer and received no notice, you can ask whether AI was used in the decision. You are entitled to be told, even while the mechanics of how they should have told you remain unsettled.
