Illinois: you must be told when AI is used on your application
Since January 2026 an Illinois employer has to notify you when artificial intelligence is used in a hiring, promotion or other employment decision, and may not use your zip code as a stand-in for a protected characteristic.

Section 01
What this page is
This is information for job seekers, not legal advice, and it is current as at August 2026. This area moves quickly, so check the primary source linked at the end before relying on any of it for a decision that matters.
Section 02
What the law covers
HB 3773 amends the Illinois Human Rights Act and took effect on 1 January 2026. It reaches recruitment, hiring, promotion, discipline and discharge, so it is broader than a hiring rule.
Section 03
What you are entitled to
To be told when AI is used in a decision about you. The Act also prohibits an employer from using a zip code as a proxy for a protected class, which addresses a specific and well documented route by which a model reproduces discrimination it was never explicitly taught.
Section 04
The gap worth knowing about
The Illinois Department of Human Rights proposed rules setting out when notice must be given, in what wording and by what means, and then withdrew them.
The statutory duty is unaffected and still applies. What is unsettled is the detail, so the notice you receive may vary between employers, and there is no standard form to compare it against yet.
Section 05
What to actually do
If you applied to an Illinois employer and received no notice, you can ask whether AI was used in the decision. You are entitled to be told, even while the mechanics of how they should have told you remain unsettled.
Pro tips
Do these
Check the date on anything you read about AI hiring law. Several widely cited statutes have been postponed, repealed or replaced.
A disclosure rule tells you what is happening. It does not usually give you a right to a different process.
None of these laws gives you a right to see your own score or ranking.
Knockout questions, not resume parsing, are what genuinely rejects an application automatically.
Asking a recruiter directly costs nothing, and how they answer tells you something either way.
Avoid these
Delete these
Assuming a law described in an article from last year is still in force. Three of the eight jurisdictions we track have moved.
Expecting to be shown your score. No jurisdiction on this page grants that.
Treating a disclosure requirement as a right to a human reviewer. Only New York City comes close, and it is a request rather than a guarantee.
Believing a model deleted your application when a knockout question is the likelier explanation.
Rewriting a resume for software rather than for a reader. The changes that help a parser help a person too.
